In an injury claim you are entitled to recover your
medical bills, loss of earnings, property damage and an amount for pain
and suffering. All of these items must be available for your lawyer
to attempt to settle your claim. For Example your attorney cannot
attempt to settle your claim until your final medical bills and reports are
ready.
Once your medical bills, property damage, and loss of
earnings are ready your lawyer will prepare a demand letter and send it to
the insurance company. The negotiation process will begin at this
point. Once an offer is made, your attorney is required to discuss
the offer with you. If a reasonable settlement figure cannot be
achieved, your attorney will file a complaint to start legal proceedings
against the other side.
